Deferment from mobilization — what enterprises can reserve workers
On May 18, a new law on mobilization entered into force in Ukraine, according to which a certain category of enterprises can reserve up to half of their employees. However, this is not allowed for everyone.

Which companies can reserve their employees in October
As you know, the rules for booking employees are not the same for all companies. Yes, some of them can book up to half of their employees, some have no limit on the number of employees booked, and others cannot issue a deferral at all.
In addition to MPs, their assistants, beneficial owners of critical enterprises, civil servants involved in the analysis of draft laws or the support of information and communication technologies of the National Parliament and the Cabinet of Ministers, conscripts in a number of enterprises, institutions and organizations can also receive reservation from mobilization.
However, there is one main condition: enterprises must be important for the functioning and defense of the state. In addition, the list of enterprises that can book up to 50% of their employees includes:
• media and culture companies;
• manufacturers of goods for the army;
• enterprises that produce and repair military goods, equipment, ammunition;
• enterprises that have been assigned mobilization tasks;
• other enterprises which are critically important for the Ukrainian economy.
The maximum economy booking is only available for six months, after which it needs to be extended.
As for enterprises that do not have a limit on the number of booked employees, the list includes:
• enterprises of the fuel and energy complex (and their contractors), which ensure the uninterrupted functioning of the energy sector of Ukraine;
• enterprises that ensure the functioning of communication networks and emergency works in Dnipropetrovsk, Donetsk, Zaporizhzhia, Kyiv, Luhansk, Mykolaiv, Odesa, Poltava, Sumy, Kharkiv, Kherson, Chernihiv regions and Kyiv;
• enterprises that received grants for the development of innovations and technologies for defense needs;
• enterprises performing work on the construction of fortification structures;
• employees of the UN, diplomatic institutions, representative offices of international organizations, which are recognized as critically important for the functioning of the economy;
• the Red Cross Society of Ukraine and other Ukrainian non-governmental humanitarian organizations;
• institutions and organizations that include full-time national teams of Olympic, non-Olympic sports and sports for people with disabilities.
Despite this, there are conditions that enterprises must fulfill in order to protect their workers from mobilization, in particular:
• to be a resident of "Diya.City";
• to pay taxes for the tax year in the amount of more than 1.5 million euros (or amount in the hryvnia equivalent according to the exchange rate);
• receive income in foreign currency for the reporting tax year in the amount of more than 32 million euros (credits and loans are not taken into account);
• do not have arrears in payment of unified social tax;
• to pay salaries that are not lower than the regional average;
• be included in the list of objects of state property or important ones for ensuring the needs of the territorial community.
It should be reminded, that recently social activist Oles Donii criticized the idea of economic reservation. He believes that this is the legalization of a situation where "only the poor will fight at the front line".
At the same time, the National Parliament currently does not have enough votes to pass a decision on economic reservation.
