This Agreement outlines the terms and conditions for accessing the products of LLC "MEDIAMEREZHI" (hereinafter referred to as the "Company"), including the current website https://novyny.live (hereinafter the "Site"), its subdomains, services, and content. Definitions

User Agreement, Agreement — a document presented electronically as a separate page on the website https://novyny.live. It outlines the rights and obligations of visitors and their relationship with the website owner.
Company — the owner of the Site, its services, content, and related information.
User — an individual aged 18 or older who interacts with the Site and uses its functionalities as intended.
Site — the web resource https://novyny.live.
Service — the functional capabilities of the Site used by the User, e.g., RSS feed, polls, video player, sharing, commenting, etc.
Content — includes the text, audiovisual content, infographics, photos, images, and other informational materials on the Site.
UGC — user-generated content.
Editorial Team — Company staff responsible for editorial policy, content management and publication, and handling Agreement-related issues.

1. General Terms

1.1. By using the Company’s products regulated by this Agreement, including the Site (desktop and mobile versions), and any of its features (e.g., RSS feeds, API interfaces, video players, advertising services, and other available services), the User agrees to comply with all provisions of this Agreement.
1.2. The Company may change, add, or remove parts of this Agreement at any time without personally notifying the User, but must update the "Last Updated" date. Changes become effective immediately upon publication. Users must review the Agreement before each use of the Site.
1.3. If the terms of this Agreement or any updates are unacceptable to the User, they may stop using the Site and/or its Services. Continued use signifies acceptance of the terms and changes.
1.4. The Site may modify, suspend, or terminate any Service at any time, restrict features or access to content or services without prior notice or obligation.

2. Provision of Services

2.1. All Company Services are provided "as is" without warranties or guarantees.
2.2. The Company aims to ensure Services are available but does not guarantee they will be uninterrupted, timely, or accurate. Delays, outages, inaccuracies, UX issues, and geographic restrictions are possible.

3. List of Services

3.1. Site content and services are for personal, non-commercial use. All materials (text, images, infographics, audio, video, UI, etc.) are protected under Ukrainian copyright law and belong to the Company or designated content providers. Users must comply with all copyright notices and restrictions.
3.2. Services and Content are protected by copyright, trademarks, trade secrets, database rights, and other intellectual property laws of Ukraine and international law. Users may not alter, publish, transmit, participate in the transfer or sale, reproduce, create derivative works, rewrite, distribute, or otherwise use the Content or Services in whole or in part.
3.3. Copying, downloading, or storing any Content for purposes other than personal use is strictly prohibited without prior written consent from the Editorial Team (info@novyny.live).

4. UGC

4.1. By posting content on the Site (e.g., reviews, comments), Users confirm they have the legal rights to do so and that it does not violate any Ukrainian or international laws or third-party rights.
4.2. Users may not:

• Post defamatory, obscene, pornographic, offensive, or illegal content;
• Impersonate others or misrepresent identity;
• Intentionally post misleading content;
• Upload malware, viruses, spyware, or other harmful software/files;
• Distribute advertisements or spam;
• Threaten or insult others based on race, religion, nationality, gender, age, region, or political beliefs.

4.3. Violations result in immediate and permanent suspension of access.
4.4. UGC must be non-commercial. Users may not share fundraising, advertisements, or sales offers without Editorial Team consent.
4.5. UGC (forum posts, comments, videos, audio, photos) may be edited, deleted, modified, published, or reused by the Company.
4.6. Users grant the Company a perpetual, exclusive, international, royalty-free license to use, publish, distribute, display, store, adapt, and modify their content on Company platforms and channels.
4.7. Users are fully responsible for their content under Ukrainian and international law. The Company reserves the right to delete or edit content deemed offensive, defamatory, obscene, or infringing.

5. Use Restrictions

5.1. Users may not attempt to bypass restrictions, reverse engineer, decrypt, or interfere with the Site, Services, Content, or data.
5.2. Under Ukrainian law, Users are prohibited from:

• Accessing Site data or Services without proper authorization;
• Using automated tools (crawlers, bots, scripts, parsers) to collect Site data or Content;
• Using tools or third parties to affect the Site’s integrity, confidentiality, or availability;
• Caching Site content;
• Launching DoS/DDoS attacks.

Such actions may lead to legal consequences, including civil, criminal, or administrative liability.

6. Use of Exclusive Content

6.1. Any use of exclusive materials from the Site is allowed only with a source link to Novyny.LIVE.
6.2. Online media must include a direct, searchable hyperlink to the original Novyny.LIVE material.
6.3. Getty Images photos on the Site may not be redistributed in any form without copyright holder permission.
6.4. The Editorial Team may not necessarily share the opinions expressed in authored articles.

7. Obligations and Warranties

7.1. Users warrant that:

• Their materials do not infringe copyrights, contain plagiarism, defamation, or unlawful content;
• They are at least 18 years old, or their parents/guardians have read and accepted the Agreement on their behalf.

7.2. The Company does not guarantee the accuracy or reliability of any User-submitted or third-party content.
7.3. The Company is not liable for interactions between Users or any reliance on opinions or information shared via the Services.
7.4. The Company is not responsible for financial or other losses resulting from reliance on Site content or Services.

8. Third-Party Content

8.1. The Site, Services, and Content may link to external websites. The Company does not control or take responsibility for third-party content or availability.

9. Miscellaneous

9.1. This User Policy shall be interpreted and enforced under the laws of Ukraine and international law.
9.2. Users agree to report any violations of this Agreement as soon as they become aware.
9.3. For copyright infringement claims, contact info@novyny.live with:

• A scan of the claimant’s authorization to act on behalf of the rights holder;
• A description of the copyrighted work allegedly infringed;
• A description, screenshot, or link to the infringing material;
• Your contact details (email and phone number).
